Decree Law 18 of 17/3/2020 equated Covid-19 infection contracted during the performance of work activity to a real injury.
It follows that the principles established regarding the liability, especially criminal liability, of the employer, as the party called upon by law to assess the health and safety risks of personnel and to take the necessary measures to protect their physical integrity, will apply.

The employer could then be held criminally liable for the employee’s Coronavirus infection if it is established that the infection was contracted precisely because of the employer’s failure or inadequacy to take specific measures aimed at containing Covid-19 infection in the workplace.
In such a case, there could also be administrative liability of the company under Legislative Decree
231/2001 resulting in the application of pecuniary and prohibitory sanctions such as, disqualification from conducting business, suspension or revocation of authorizations, licenses or concessions, and prohibition from contracting with the public administration.
